Fiji Matai Specialist Agents -  Programme Requirements and Terms and Conditions:

  1. Introduction and Objectives

    1.1.      The Fiji Matai Specialist Programme (FMSP) is Tourism Fiji’s (TF’s) global training programme. The FMSP is designed to provide international travel selling agents (Agent’s) with the knowledge and skills to confidently promote and sell Fiji as a destination. It offers travel agencies (Agency or Agencies) and their staff an online platform and training resources to help sellers promote Fiji effectively.

    1.2.      The online learning environment through the Fiji Matai Specialist platform (FMSP Platform) allows Agents complete flexibility throughout the course, learning in their own time, at their own pace. The Fiji Matai Specialist Program is broken into courses with modules and lessons. There are knowledge checks in the form of quizzes required to be completed and these need to be passed in order to move to the next stage and through the attainment levels of BRONZE, SILVER and GOLD under the FMSP.

    1.3.      Agent’s will also be able to enjoy and have access to exclusive tradeshows, roadshows and events, supported by Tourism Fiji or webinars with partners direct from Fiji either live in the Agent countries or on a remote or virtual basis. There will also be video training sessions and live Q&As, to ensure Agent Members are kept up to date with the latest activities of TF and news from the destination.

    1.4.      Other perks of the FMSP for Agents include the chance of being invited to participate in familiarisation trips to Fiji, in line with agreed offerings that are made available by TF from time to time under the FMSP.

    1.5.      The FMSP is intended to be an ever evolving and developing program with vast opportunities for both Agent’s and TF partners to interact and connect, and TF look forward to working with them to provide the support and tools they need to sell Fiji like never before.

    1.6.      Through the FMSP, TF aims to raise awareness of Fiji to frontline travel agents and agencies and to highlight the diversity of holiday experiences, ensuring Fiji is top of mind when speaking with customers.

  2. Registration

    2.1.      FMSP is open to international travel agents from outside of Fiji and also domestically based Fiji agents who sell or are interested in, promoting and selling Fiji. There are minimum standards and a series of online registration steps to be met before the Agent is able to represent themselves as a Fiji Matai Specialist (FMS). Benefits may vary depending on whether the Agent or FMS is based inside or outside of Fiji. Tourism Fiji reserves the right to refuse registration into the program at any stage and at its discretion. Registration can be made online at the FMSP website (Site).

    2.2.      Each Agent that successfully completes the registration and is accepted by TF onto the FMSP, shall be provided with a unique user account (FMSP User Account). This will allow authenticated user access to the FMSP Platform including all FMSP training materials, information and features available on the FMSP Site. Registration is personal to the Agent completing the registration to the FMSP and may not be exchanged or transferred to any other person or individual.

    2.3.      On successful completion of the training modules together with a final examination, the Agent will be awarded non-exclusive Fiji Matai Specialist (FMS) status and be entitled to the benefits attributable to the applicable status achieved as further set out in Section 4 below, including the right to use the applicable FMSP status logo. The Fiji Matai Specialist status is tiered into BRONZE, SILVER and GOLD levels depending on achievement and attainment. Each Agent must complete all required courses and examination in each tier before receiving the status for that specific tier. Each of the individual tiers may also require evidence from the Agent of additional requirements such as achieving a certain level of confirmed travel bookings as further set out in the “Fiji Matai Specialist Programme - How it Works” details at https://bit.ly/mspicx22. Additional courses and further training and/or activities may be required to maintain the status of each tier.

    2.4.      In circumstances where: a. an FMSP User Account has been inactive for a period of twelve (12) calendar months; or b. an Agent with an FMSP User Account has not within a period of 18 months from the date of registration achieved an accreditation as a Fiji Matai Specialist in one of the three status tiers of BRONZE, SILVER or GOLD; then TF shall without notice to the applicable Agent be entitled (without liability) to permanently delete such FMSP User Account from the FMSP Platform (including all data and information contained therein). Once this happens the responsible Agent for the FMSP Account will not have the ability to retrieve any data or reactivate the same FMSP User Account.

    2.5.      If the Agent whose FMSP User Account has been deleted as a consequence of an activity under section 2.4 above, still wishes to join the TFSP then they shall be required to recreate another FMSP User Account, through the registration process, and in turn, will be required to meet the requisite accreditation to qualify as a Fiji Matai Specialist.

    2.6.      The online FMSP Platform is operated and managed by Mogul Global, Black Diamond Agency Limited, 15 Bedford Street, London, WC2E 9HEand by accessing the online FMSP Platform you agree to the Mogul Terms of Condition for the use of FMSP Platform which are available for view when Agent sign’s on.

  3. Agents’ Code of Conduct

    3.1      The Agent and any certified Fiji Matai Specialist shall under the FMSP: a. use their respective best endeavours to promote and market travel to and tourism in Fiji; b. conduct the promotion and marketing of travel to and tourism in Fiji in an honest, open, ethical and bona fide manner in accordance with efficient and sound business practices and with all due skill, care and diligence; c. not make any representation on behalf of TF except as are expressly mentioned in TF materials and information provided by TF including as part of the FMSP, or act in any manner which is misleading, deceptive or untrue or which may be likely to bring TF into disrepute; d. cultivate and maintain good relations with customers and potential customers in accordance with sound commercial principles; and e. comply with all relevant laws, regulations (for example, privacy and data protection laws, public health regulations), and Tourism Fiji and FMSP policies and guidelines (including the prescribed code of conduct for FMSP, COVID-19 guidelines for FMSP events etc) or otherwise as directed by TF from to time in connection with their participation in FMSP.

    3.2      It is intended that the Agent and Fiji Matai Specialist shall, at the Agent’s or Agency’s expense: a. make themselves available at all reasonable times and upon reasonable notice to TF for the training provided by TF in respect of Fiji Matai Specialist status, and for consultation and advice relating to the TFSP and the furtherance of tourism in Fiji; b. attend meetings with representatives of TF and such customers or prospective customers as may be reasonable and necessary for the proper performance of its duties hereunder and so as to meet the objectives of the TFSP; c. attend such exhibitions, webinars, roadshows and other sales outlets (either live or virtually) as TF or the Agent may make available and have been advised are commercially suitable for the objectives of the TFSP: and d. be employed at the services of the Agency (office or home office based) or in case of self-employment have working hours of at least twenty (20) hours per week on activities related to promoting tourism in Fiji. (This requirement may be waived by TF at its absolute sole discretion on a case-by-case basis at the time of registration).

  4. FMSP Levels, Accreditation and Benefits

    4.1      Within the FMSP there are three tiers of Fiji Specialist that Agents nominated persons may attain based on a points system. The Agent must meet the minimum points requirements for each of the FMSP levels to be considered a Specialist for that Level of attainment. The tiered levels of FMSP attainment are: GOLD, SILVER or BRONZE levels. These tiers are set out in Table A below and further described in “Fiji Matai Specialist Programme - How it Works” details at https://bit.ly/mspicx22

    4.2      The FMSP is broken into a series of six courses with modules and lessons as set out on the FMSP Site and further detailed below. More courses may be added from time to time.

    4.3      Agents must take interactive quizzes to become Fiji Specialists and receive tiered status award badges as a recognised qualification and knowledge check of expertise on achieving the minimum pass mark for the accredited number of courses successfully completed. To achieve status as a GOLD or SILVER accredited Fiji Specialist, the Agent will also have to satisfying the other criteria within the respective tiered FMSP level as set out in Table A below:

  • Completion of “Introduction to Fiji” course with 7 chapters.
  • Completion of two more of the  courses offered (each 50 points).
  • Get 210 points in total (50 through BRONZE, 100 through additional courses, and the remaining 60 points through either bookings or another course and through booking(s)).
  • Points accumulated through bookings need to be logged into system via the booking form. Number of points accredited will come from a multiplication of passengers on the booking times number of nights. (e.g., 2 passengers for 5 nights = 10 points).
  • To ensure authenticity of bookings being logged, Tourism Fiji may randomly make enquiries to ensure the bookings are legitimate and accurate.
  • Any bookings being logged must be new bookings made from the time a Fiji Matai Specialist achieves their Bronze Status
  • 6 courses in total.
  • Have visited Fiji in the past 2-5 years, excluding Denarau
  • At the end of each calendar year each sales region of TF will give GOLD status to a defined number of FMSPs based on their sales performances and the fulfilment of the above criteria.
  • The regions will announce the number of GOLD specialists to be selected at the beginning of each year.
  • GOLD status is only valid for the next 12 months after announcement and will need to be re-earned each year.

4.4       Benefits

          Each of the 3 tiers of specialisation provide a range of rewards and benefits to the Fiji Specialist. The current list of such rewards and benefits that attach to each of the three layers of specialisation is set out in the Table B below.

4.5       All rewards and benefits personal to the Specialist and are provided at the discretion of Tourism Fiji and subject to the FMSP terms set out in Section 5 below. If the Specialist moves from one Agency organisation to another then their accredited level of attainment as a Fiji Matai Specialist at that time will transfer with them.

4.6       To maintain SILVER status accreditation the FMS will need to complete at least two (2) of any new courses that will be added in the FMSP and log at least bookings worth 30 points within 12 months after first achieving SILVER status.

4.7       GOLD status - GOLD status is only valid for a period of 12 months from when the GOLD status accreditation is granted to the FMS. In order to maintain GOLD status this will need to be re-earned each year by the Agent and subject to TF’s appointment in line with the above.

4.8       If so requested or agreed with the Agent or the Agency and with their consent TF will publish the contact details of  the FMS Agents who have achieved SILVER or GOLD level of FMS accreditation on the TF consumer website: www.fiji.travel. This will enable customers and prospective  customers to contact the Agent directly in regards their Fiji travel needs. At the time of registration, Agents will have the opportunity to opt-in, or opt-out as to whether or not they wish their contact details to be published on the Tourism Fiji’s consumer website.

4.9     In addition to the Benefits listed in Table B below, an Agency with a GOLD status may be entitled to the benefit of access to a Co-Marketing Fund to be used in conjunction with TF on initiatives agreed between TF and the Agency on a case-by-case basis.   TF’s contribution into this Co- Marketing fund shall be solely at TF’s discretion and with TF’s express written approval. Any decision by TF on contribution to a Co-Marketing fund initiative will be based on, and subject to factors such as:  the available funds at the time, the strength of the marketing proposal from the Agent to achieve the desired objective and whether the proposed activity under the initiative aligns with TF’s overall objectives.

  • Invitation to TF’s exclusive Global Matai Annual Conference in Fiji with pre-famil & option for extended stays.
  • Listing on Tourism Fiji Consumer website as GOLD Fiji Matai Specialist.
  • GOLD status logo for agent’s communication
  • Option to apply for a capped coop-marketing fund to promote Fiji.
  • Free participation in consumer facing webinars or similar concepts per region.
  • Listing on the Matai programme as one of TF’s esteemed GOLD Specialists.

 

4.10    Accreditation:

a.    Once an Agent has satisfied and completed one or more of the tiered stages of the FMSP they shall be entitled and permitted to describe themselves as having achieved the status of a Fiji Matai Specialist (FMS) in respect of travel to and tourism in Fiji.

b.   The Agency, in which the FMS is employed, shall then be entitled and permitted the use of the generic “Fiji Matai Specialist Agency” logo or mark in its internal and external communications with customers and others, for so long as the Agent remains a Fiji Matai Specialist and is employed at this agency The use of such logo shall be in accordance with Section 5.13 below;

c.    A Fiji Matai Specialist shall be held to the standards as set out in the Code of Conduct as set out in this Section 4 and the terms of the FMSP.

 

5.          FMSP Terms

The following terms and conditions shall apply to the FMSP. Please read these FMSP Terms carefully as they apply to your use of the FMSP internet site and your responsibilities as an FMS. By using this Site and becoming an FMS you agree to be bound by these terms and conditions:

5.1       In these FMSP Terms, (and in addition to any other definitions contained in this FMSP Requirements section),  “we” or “us” or “TF” means Tourism Fiji. “Agent”, “you” or “your” means an individual Agent who wishes to become a Fiji Specialist under the FMSP.

5.2       The FMSP is a global program  and TF reserves the right to make changes, corrections, cancellations and/or improvements to the FMSP (including the FMSP Terms), and to the information, products and programmes described in such information located at  www.specialist.fiji.travel at any time and without notice by updating the Site details. The revised terms will take effect when they are posted, and TF recommends you review the FMSP Site details and the terms and conditions from time to time.

5.3       Participation in the FMSP is provided without the payment of any fees of charges by the Agent or Agency whether for registration or otherwise and made available on a free of charge basis. Benefits received under the FMSP are personal to the FMS and cannot be exchanged, transferred or sold for cash or otherwise. 

5.4       The content and information displayed on the FMSP Site is the property of the TF. The downloading, reproduction or retransmission of FMSP Information (other than for non-commercial individual use or use in in connection with the scope and objectives of the FMSP as set out in Section 1) is strictly prohibited.

5.5       TF is providing information and services on the internet as a part of the FMSP benefit in furtherance of TF’s non-profit status.TF makes no representations about the suitability of this information and these services for any purpose.

5.6       You agree to comply with the Terms of Use of the FMSP platform as determined by the operator of the platform as regards your use such platform and for which further set out in Section 2.4 above. 

5.7       The FMSP Site may contain or reference trademarks, patents, copyright materials, trade secrets, technologies, products, processes or other proprietary rights of TF and/or other parties. No licence to or right in any such trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes and other proprietary rights of the FMSP Site or  TF and/or other parties is granted to or conferred upon you without the express written consent of TF or the respective mark or rights holder.

5.8       You agree that you will not use any device, software or other instrument to interfere or attempt to interfere with the proper working of the FMSP Site, and that you will not take any action that imposes an unreasonable or disproportionately large  or heavy workload on our infrastructure or manual process to monitor the Site or copy our web pages or the content contained herein, without the prior express consent from an authorised TF representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this FMSP Site). If we have provided you with, or you have created a unique password, one of its purposes is so that access to information related to you and can be restricted to only you. It is your responsibility to protect the confidentiality of the password. TF assumes no liability for any access to information that is executed with the password provided to or created by you. We strongly recommend that you change the password on a periodic basis.

5.9       All FMSP INFORMATION HELD ON THE FMSP SITE IS PROVIDED ‘AS IS’ WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Some jurisdictions do not allow the exclusion of implied warranties and to the extent this is the case the above exclusion may not apply to you.

5.10    With respect to all communications you make to TF regarding FMSP Site  information (including but not limited to feedback, questions, comments, suggestions and the like) and subject to any privacy obligations as set out in these terms and conditions or otherwise as required or prohibited by law: (a) you shall have no right of confidentiality in your communications,  TF shall have no obligation to protect your communications from disclosure; (b) TF shall be free to reproduce, use, disclose and distribute your communications to others without limitation; and (c) TF shall be free to use any ideas, concepts, know-how, content or techniques contained in your communications for any purpose whatsoever, including but not limited to the development, production and marketing of products and services that incorporate such information.

5.11    The FMSP Site may contain links to other companies and resources on the internet.  Such links and references are provided merely as aids to help you identify and locate internet resources and other companies that may be of interest to you and are not intended to state or imply that TF sponsors, is affiliated or associated with, or is legally authorized to use any trade name, registered trademark, logo, legal or official seal, or copyrighted symbol that may be reflected in the links.  TF is not responsible for any of the content, representations or advice available on any internet sites linked to this site.  Any statements, views or opinions expressed via such links are the statements, views and opinions of the companies, authors and publishers of the materials contained therein and do not bind or create any legal liability on the part of TF or any organisation or individual with which TF is affiliated.  Provision of such links does not imply endorsement by TF of the materials contained therein.

5.12    The FMSP Information contained on the FMSP Site may contain inaccuracies and typographical errors. TF shall not assume responsibility or liability for any such inaccuracies, errors or omissions, and shall have no obligation related to information affected by such inaccuracies other than to correct such information when it becomes aware inaccuracies or errors.

5.13    Privacy  

a.   All information received by TF in applications and throughout the FMSP will be treated in confidence with regard to public disclosure. We process information about you in accordance with our Privacy Statement located at https://www.fiji.travel/articles/privacy-statementas reasonably required to meet its legal or regulatory obligations or for its other reasonable business purposes. We may further disclose information about you to any third parties including its subcontractors, regulators and any party based in any jurisdiction including a jurisdiction provided that such disclosure is reasonably required in connection with such purposes and is at all times in compliance with applicable data protection legislation.

c.    Where TF wish to publish contact details of the Agent on the FMSP Site then TF shall only do so with the express consent of the Agent as required. 

 

5.14    Use or FMSP Status logo: 

a.   TF hereby licenses you to use the FMSP status logo solely for the purpose of enabling you to promote Fiji effectively in line with Section 1 and the code of conduct.

b.     you shall ensure that it uses and displays the FMSP status logo strictly in a manner and format approved in writing by TF or as set out in guidelines issued by TF around such use of marks and logo’s (a copy of which is available on request). The Agent and or the Agency understands and accepts that the integrity of TF’s logos i and any use is of paramount importance to TF and should only be done in line with TF’s guidelines. The Agent or Agency  will ensure that the  FMSP status logo is placed in an area that is clearly visible. Where the FMSP status logo is to be provided in print or digital form, it will always need a minimum clearance space around it of the width of the Tapa circle that forms part of the FMSP status logo. No other content should sit within this minimum clear space. The FMSP status logo should only be presented where it has a minimum size as follows: For print - 40mm, or 160px for digital.

c.    You shall not alter, remove or tamper with any TF logos, or other means of identification used in relation to the FMSP or use the FMSP status logo in any way which may be misleading, deceptive, reduce their distinctiveness or impact the goodwill or reputation of TF.

d.   If TF deems that you are using the FMSP status logo in an inappropriate or unapproved manner TF may in its absolute discretion and without recrimination, request that you change the manner in which the FMSP status logo is being used or to cease using them altogether, in which case then you must immediately comply with such request and indemnify TF for any loss or damage associated with such misuse.

5.15     Termination

a.    An Agent () or TF may terminate an Agent’s registration under the FMSP with or without cause, immediately on written notice to the other. 

b.   TF may terminate of withdraw the FMSP on notice to the Agent and Agency or Fiji Matai Specialist as the case may be.

5.16    Your use of some parts or features of the FMSP Site may be governed by additional terms of use. Where this is the case, you will be notified accordingly, and those additional terms of use will apply to your use of such parts of the FMSP Site or features in addition to these terms set out in Section 1-5. 

5.17    By accessing any part of this FMSP Site, you shall be deemed to have accepted these terms and conditions in full, which as herein set out comprise the entire Agreement.  In the event that you, at any time, do not accept or no longer accept any or all of these Terms, and conditions you should immediately cease use of the FMSP Site and representing yourself as a Fiji Matai Specialist.

5.18    Limitation Of Liability: - TF shall not be liable for any loss of use, interruption of business, or any direct or indirect, special, incidental, or consequential damages of any kind (including but not limited to lost profits) regardless of the form of action, whether in contract, tort (including negligence), strict product liability, or otherwise, even if TF has been advised of the possibility of such damages, howsoever arising, out of engagement in the Fiji Matai Specialist Program or access to or use of the FMSP Site and the FMSP Platform.

5.19    Jurisdiction and Applicable Law:  The courts of Fiji will have exclusive jurisdiction over any claim arising from, or related to, your participation in the FMSP and your use of the FMSP Site.  This, however, shall not prevent TF from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of these FMSP Terms in any other jurisdiction.  These FMSP Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Fiji.

By using the Site, you confirm that you have read and understood our Privacy Policy.

Availability of the Platform

We may update the platform from time to time, and may change its content at any time. However, please note that any of the content on the platform may be out of date at any given time, and we are under no obligation to update it.

Due to the inherent nature of the internet, errors, interruptions and delays may occur in the service at any time. Accordingly, the Site is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind. We do not accept any liability arising from any interruption in availability.

We reserve absolutely the right to withdraw or suspend the platform where we deem this to be necessary without notice and will not be liable to you for such unavailability.

No Reliance on Platform Content

The information on the platform, especially that which is posted by others users in discussion boards, such as the knowledge forum, or other social functions on the platform does not necessarily reflect our views and opinions.

You are responsible for checking the accuracy of relevant facts, instructions, suggestions and/or opinions given on the platform before entering into any commitment based upon them.

We do not accept any liability arising from any inaccuracy or omission in the information.

Your Account and Security

If you choose to register a user name and password, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user at any time if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.

If you know or suspect that anyone other than you knows your username or password, you must promptly notify us at by email at info@mogul.global.

Copywrite and Trademarks

We are the owner of the intellectual property rights of the platform, our clients own the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. Nothing in these Terms of Use shall be construed as conferring any licence to use or reproduce any content included on the platform, which you may only use in accordance with the instructions and information provided by material owner, or any other information which we may notify you of separately.

Without limitation to the above, you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text or copy or distribute any material for any commercial or business purpose. No use of our name, logos and/or other trade marks (whether registered or unregistered) may be made by you without separate express written agreement being given by us, which shall be at our sole discretion.

In the event of any use of material in breach of these Terms of Use, your right to use the platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Prohibited Use

You agree not to use the platform to create a database (electronic or otherwise) that includes material downloaded or otherwise obtained from the platform to misrepresent your identity to disseminate any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes", or any other form of solicitation or for any other commercial purposes (which would include using the platform to promote or encourage the sale of your goods/services to transmit or re-circulate any material obtained from the platform to any third party except where expressly permitted on the platform.

Any links on our platform (particularly those posted by other users in discussion boards, such as the knowledge forum) may take you to third party websites over which we have no control. You acknowledge that the content on those pages is not subject to our control, their owners may be independent from us and we do not endorse or accept any responsibility for their content. We will not be liable for any loss or damage that may arise from your use of them.

Computer Viruses

We will use reasonable endeavours to ensure that the Site does not contain or promulgate any viruses or other malicious code. However, it is recommended that you should virus check all materials downloaded from the platform and regularly check for the presence of viruses and other malicious code.

Submission of Information, Including Personal Data

These Terms of Use are governed by English law and are available only in the English language. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising under these Terms of Use.
